Privacy Policy

This policy explains what personal information Ntradex collects, why we collect it, how we use and protect it, and what rights you have over your data.

Introduction

Ntradex Solutions Inc. ("Ntradex," "we," "our," or "us") is committed to protecting the personal information of our users. This Privacy Policy describes how we collect, use, store, disclose, and protect your personal data when you access or use the Ntradex platform, including our web application, mobile applications, and related services (the "Services").

By registering for an account or using our Services, you acknowledge that you have read and understood this Privacy Policy and consent to the collection and use of your information as described here. If you do not agree, please do not use our Services.

This policy is governed by Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. Where our Services extend to users in the European Economic Area or the United Kingdom, we also adhere to the General Data Protection Regulation (GDPR) and UK GDPR to the extent applicable.

How Ntradex Uses Your Personal Information

We collect and use your personal information solely for legitimate business purposes directly related to delivering, improving, and securing the Services. Specifically, we use your information to: verify your identity and assess your eligibility for our Services; process transactions you initiate through the platform; comply with legal and regulatory obligations, including KYC, AML, and tax reporting requirements under PCMLTFA and FINTRAC regulations; communicate with you about your account, transactions, and changes to our Services; improve the performance and user experience of our platform; detect, investigate, and prevent fraudulent or illegal activity; and respond to your support requests or complaints.

We do not use your personal information for automated decision-making that produces significant legal or similarly significant effects on you, unless we are legally required to do so or you have consented explicitly.

Information We Collect

3.1 Information You Provide Directly

When you register for and use our Services, we collect personal information that you provide to us, including: your full legal name, email address, date of birth, gender, occupation, and residential address; government-issued identification documents (such as a passport, driver's licence, or national ID); financial information required to complete transactions, including bank account details and funding source information; bank statements or other financial documents required for KYC verification; business registration documents if you are using our business services; and any other information you submit when contacting our support team or completing forms on our platform.

3.2 Information We Collect Automatically

When you access our platform, we may automatically collect technical and usage data, including: your IP address, browser type and version, operating system, device identifiers, and referring URLs; log data about your interactions with the platform, including pages visited, features used, and transaction activity; and cookie and tracking data as described in Section 8.

3.3 Information from Third Parties

We may receive information about you from third parties as part of our verification and compliance processes, including identity verification providers, fraud prevention services, and financial institutions. We handle all such information in accordance with this policy.

Information Sharing and Disclosure

Ntradex does not sell, rent, or trade your personal information to third parties for marketing purposes. We will never share your data with advertisers. We may disclose your information in the following limited circumstances:

Service Providers: We share data with trusted third-party service providers who assist in operating the platform, processing payments, verifying identities, preventing fraud, and providing customer support. These providers are contractually obligated to use your information only for the purposes we specify and to maintain appropriate security standards.

Regulatory and Legal Obligations: We are legally required to disclose information to FINTRAC and other financial intelligence authorities in connection with our AML and CTF reporting obligations. We may also disclose information in response to a valid court order, subpoena, or other lawful legal process, or where disclosure is necessary to establish or defend legal claims.

Business Transfers: In the event of a merger, acquisition, or sale of all or part of our assets, your information may be transferred as part of that transaction. We will provide notice via email or a prominent notice on our platform before your information becomes subject to a different privacy policy.

Third-Party Links: Our platform may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties and encourage you to review their privacy policies.

Confidentiality and Security

Ntradex takes the security of your personal information seriously. We implement physical, electronic, and procedural safeguards designed to protect your information against unauthorised access, disclosure, alteration, or destruction. Your data is stored on encrypted servers with access restricted to authorised personnel who need it to perform their job functions.

We use industry-standard encryption (TLS) for data transmission and enforce strong access controls, multi-factor authentication for internal systems, and regular security assessments. Despite these measures, no method of transmission or storage is 100% secure. We encourage you to use a strong, unique password for your account and to contact us immediately if you suspect any unauthorised access.

In the event of a data breach that is likely to result in a risk of significant harm to affected individuals, we will notify the Office of the Privacy Commissioner of Canada and affected users in accordance with our obligations under PIPEDA.

Data Retention

We retain your personal information for as long as is necessary to fulfil the purposes for which it was collected, including to provide you with the Services, maintain our business records, and comply with legal obligations. Specifically:

Transaction records and identity verification documentation are retained for a minimum of five years following the end of the business relationship, in accordance with FINTRAC's record-keeping requirements under PCMLTFA. This period may be extended where we are subject to a legal hold, audit, or investigation.

Account information and communication records are retained for the duration of your account plus a reasonable period thereafter, typically five years, to allow us to respond to any subsequent queries, disputes, or regulatory enquiries.

When your data is no longer required, it is securely deleted or anonymised in accordance with our data management procedures.

Your Rights

Subject to applicable law and certain exceptions required by our regulatory obligations, you have the following rights with respect to your personal information:

Access: You may request a copy of the personal information we hold about you. We will respond to access requests within 30 days.

Correction: If any of your personal information is inaccurate or incomplete, you may request that we correct it. You can update many details directly within your account settings.

Deletion: You may request the deletion of your personal information where we no longer have a legal basis to retain it. Note that regulatory obligations (such as FINTRAC's record-keeping requirements) may prevent us from deleting certain records during the mandatory retention period.

Withdrawal of Consent: Where we process your data on the basis of consent, you may withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing carried out before withdrawal.

Portability (EEA/UK users): Where GDPR applies, you may request your personal data in a structured, machine-readable format for transfer to another service provider.

Cookies and Tracking Technologies

Ntradex uses cookies and similar tracking technologies (including web beacons and pixel tags) to operate and improve the platform, analyse usage patterns, and for security purposes. Cookies are small text files stored on your device that help us recognise you and customise your experience.

We use the following categories of cookies: Essential cookies that are necessary for the platform to function and cannot be disabled; Analytical cookies that help us understand how users interact with the platform (e.g. Google Analytics); and Security cookies that help detect and prevent fraud.

You can control cookies through your browser settings. Most browsers allow you to refuse or delete cookies. Note that disabling essential cookies will impair your ability to use the platform. For advertising and analytical cookies, you can manage preferences through our cookie consent tool or your browser's privacy settings.

International Data Transfers

Ntradex operates globally and may transfer your personal information to countries outside Canada, including to countries where we have operational infrastructure or where our service providers are located. Where data is transferred outside Canada, we take steps to ensure that appropriate safeguards are in place, such as standard contractual clauses, to protect your information consistently with the standards required under PIPEDA and applicable law.

For users in the EEA or UK, transfers of personal data outside the EEA or UK are made only where an adequacy decision applies, or where we have implemented appropriate safeguards as required by GDPR or UK GDPR.

Children's Privacy

Ntradex's Services are not directed at individuals under the age of 18. We do not knowingly collect, store, or process personal information from anyone under 18. If you are a parent or guardian and believe that a minor has provided us with personal information without your consent, please contact us at support@ntradex.ca and we will promptly delete that information from our records.

We do not knowingly collect data from children as defined under the U.S. Children's Online Privacy Protection Act (COPPA) or similar legislation in other jurisdictions. If we become aware that we have inadvertently collected such data, we will take immediate steps to delete it.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, regulatory requirements, or for other operational, legal, or business reasons. When we make material changes, we will notify you by email to the address associated with your account and by posting a prominent notice on our platform prior to the changes taking effect.

We encourage you to review this policy periodically to stay informed about how we protect your information. Your continued use of the Services after any update constitutes your acceptance of the revised policy.
